In Ohio, workers' compensation is administered by the Ohio Bureau of Workers' Compensation (BWC). Unless your employer is self-insured, the BWC will play a key role in your workers' comp claim.

Your workers' compensation process begins with filing a claim. Generally speaking, the sooner you file a workers' compensation claim after an injury, the better off you will be, since your employer will be less able to claim that your injuries were caused by an event not related to your job. The BWC will review the evidence in your claim, such as the medical evidence and other reports. After a review, they will approve or deny your claim. If your claim is approved, you will begin receiving benefits. If your claim is denied, you will be able to appeal this decision through the Ohio Industrial Commission (OIC). You must file this appeal within a limited time frame.

Do not lose heart if your claim is denied. Many claims are denied in the initial stages. In many cases, this is because the medical records were incomplete. You have a limited time to make your appeal. Our lawyers can begin representing you at any point in the process, including after your initial claim has been denied. The OIC will hear your appeal. If the OIC approves your claim, you will begin recovering benefits. If the OIC denies your claim, you may be able to take your claim through the court system.
