Consumer Protection and Automatic Electronic Payments
The Electronic Funds Transfer Act (EFTA) is an important new law designed to protect you! It may apply if you have arranged to repay or purchase goods and services through pre-authorized electronic fund transfers (EFTs). The Act covers EFTs from most banks and limits liability for unauthorized transfers if you notify the bank promptly. If you arrange recurring regular electronic payments, the merchant or creditors must, among other things, obtain prior signed authorization and provide you with a copy. Creditors and merchants may not continue withdrawals after authorization is revoked. Remedies for violations include actual damages and statutory damages between $100 and $1000 plus attorney fees.
